Raymond Geuss asserts that there are fragmented views on what human rights are and that there is no unifying principle underlying such notion. I think that this view has its merits. It conveys the particularity of our perspectives, attitudes, desires and selfunderstandings. It rejects abstractness and is committed to a thick, perspectivist, historical understanding of personhood. To understand who we are, is to understand how we arrive at being who we are. By contrast, the notion of human rights deploys abstractness, (...) unification of agency, necessity and a thin view of personhood. In this paper, I attempt to bring into focus these two aspects of the notion of human rights. I will first analyse the genealogical method advocated by Geuss and argue that it has the merit of elucidating our historical contingencies; however, it is argued that any view in favour of the genealogical method relies on the idea that evaluative or normative concepts cannot be defined in terms of a common denominator. We reconstruct the Aristotelian idea of ‘focal meaning’ as core-resemblance and show that there is a unifying concept of human rights. We conclude that the perspectivist spirit of genealogy is not far from the Aristotelian tradition. Aristotle’s inquiry into a concept that could grasp different perspectives and contingencies as opposed to a Platonic understanding of abstract and universal forms shows that genealogical worries are germane to the tradition. Law and Authority Under the Guise of the Good, by Rodriguez-BlancoVeronica. Oxford : Hart Publishing, 2014. Pp. 215.

This paper deals with Veronica Rodriguez-Blanco’s answer to the paradox of the normativity of law: How can autonomous self-legislating persons act, without compromising their autonomy and their will, following legal rules? Regarding Rodriguez-Blanco’s answer, I offer two main critiques. The first one is based on Rodriguez-Blanco’s comments to David Enoch’s paper in which I argue against the idea that a descriptive theoretical account of law can, and should, give an answer to general problems (...) of normativity due to the fact that a theoretical approach that engages in questions about the normativity of law cannot be purely descriptive, therefore against Rodriguez-Blanco I conclude that Enoch’s answer is the only response a descriptive account is able to offer. The second criticism focuses on Rodriguez-Blanco’s response to the paradox and argues that her solution is not, in fact, a descriptive one, but one that relies on strong normative premises, which as it turns out defend a perfectionist perspective towards the law.Resumen:Este trabajo analiza la respuesta que Veronica Rodriguez-Blanco propone para resolver la paradoja de la normatividad del derecho: ¿Cómo es posible que una persona autónoma actúe siguiendo los mandatos de normas jurídicas sin comprometer su autonomía ni su voluntad? El autor ofrece dos críticas a la respuesta de Rodriguez-Blanco. La primera de ellas está basada en los comentarios que Rodriguez-Blanco ha hecho sobre la propuesta de David Enoch. En este punto, el autor argumenta en contra de la idea según la cual una perspectiva descriptiva del derecho puede, y debe, tratar de responder a los problemas generales de la normatividad del derecho. De acuerdo con el autor, una perspectiva que pretenda dar respuesta a los problemas de la normatividad del derecho no puede ser una perspectiva puramente descriptiva. En este sentido, el autor sostiene que la respuesta que ofrece Enoch es la única respuesta que una perspectiva descriptiva del derecho puede dar. La segunda crítica está dirigida a la respuesta que Rodriguez-Blanco da sobre la paradoja de la normatividad. En este segundo punto el autor argumenta que la perspectiva de Rodriguez-Blanco no es una perspectiva descriptiva como ella presume, sino que adopta una perspectiva normativa la cual, además, está comprometida con una idea perfeccionista del derecho. En «What Makes a Transnational Rule of Law? Understanding the Logos and Values of Human Action in Transnational Law», Verónica Rodríguez-Blanco explora la posibilidad –y oportunidad– de la existencia de un Rule of Law (en adelante, ROL) a nivel transnacional. El objetivo de este trabajo es discutir brevemente algunos puntos relativos a diferentes facetas de la propuesta de Rodríguez-Blanco: la pregunta correcta acerca del ROL y su visión particular acerca de la acción humana (sección 2); el tipo de (...) explicación acerca de las reglas, estándares, reglamentos y principios (sección 3); las definiciones de ROL, coerción, y libertad (sección 4); las partes de la relación relevante y la noción de derecho transnacional (sección 5), y la estructura de las relaciones relevantes en contextos nacionales y transnacionales (sección 6). Intentaré, por una parte, mostrar cómo estos puntos pueden presentarse como relativamente problemáticos y por tanto debilitar la integridad de la propuesta de Rodriguez-Blanco; y, por otra parte, ofrecer algunas alternativas acerca de cómo estos problemas podrían ser resueltos para fortalecerla. A través de esos comentarios intentaré también mostrar cuáles serían, en mi opinión, los puntos importantes a considerar para cualquier discurso o propuesta sólida relacionada con éstos. In “What Makes a Transnational Rule of Law? Understanding the Logos and Values of Human Action in Transnational Law”, Veronica Rodriguez-Blanco explores the possibility—and opportunity—of the existence of a Rule of Law (from now on, RoL) on a transnational level. The aim of this paper is to briefly discuss some points related to various facets of Rodriguez-Blanco’s proposal: the correct question about the RoL and her particular view of human action (section 2); the type of (...) explanation about rules, standards, regulations and principles (section 3); the definitions of RoL, coercion, and freedom (section 4); the parties of the relevant relationship and the notion of transnational law (section 5); and the structure of relevant relationships in national and transnational contexts (section 6). I will try, on the one hand, to show how these points could appear quite problematic and thus seem to undermine the integrity of Rodriguez-Blanco’s proposal, and on the other hand, to offer some suggestions as to how these problems could be solved to strengthen her proposal. With these comments, I will also try to indicate what I think are the most important points that should be considered in any sound discourse or proposal on these subjects. Los estudiantes de la Facultad de Ciencias Económicas y de Administración de la Universidad de la República deben realizar, como trabajo final de carrera, una investigación o ensayo monográfico en un área de su interés, tutorados por un docente universitario o un investigador de reconocida trayectoria. Un gran número de estos trabajos monográficos han hecho un aporte valioso al conocimiento pero, lamentablemente, la poca difusión de éstos hace que ese conocimiento termine olvidado en los fondos de la biblioteca de la (...) Facultad, entre cientos de producciones monográficas. Se pretende en este libro, mostrar los aportes que se han generado en el área tanto de Economía de la Cultura como de Gestión de Organizaciones Culturales. Varias de las monografías fueron realizadas en la línea de investigación Costos y Gestión de Organizaciones Culturales, la cual coordino. Otros fueron realizados con antelación, como los trabajos tutorados por el referente de la Economía de la Cultura en Uruguay, el hoy fallecido Luis Stolovich. También se incluyen dos trabajos monográficos tutorados por el Dr Gustavo Buquet, quien siempre está presente a la hora de crear investigación de calidad en Economía de la Cultura. Como cada trabajo supera el centenar de páginas, no es posible publicarlos completamente, por lo que para este libro se hicieron resúmenes de esos trabajos, intentando adecuar la terminología y quitándoles el formato estrictamente científico –poco amigable para un no especialista-, de forma tal que su lectura sea accesible al público en general. Se resumieron ocho, clasificados en tres capítulos: Patrimonio, Artes Escénicas e Industria Cultural. El capítulo de Patrimonio comienza con un trabajo realizado por las Economistas Fernanda Arezo y Verónica Pereyra, titulado “Museos y Ciudadanos, el comportamiento del consumidor”, tutorado por Raúl Ramírez y por mí. Este estudio tuvo como centro explicar la modalidad de conducta de consumo del visitante montevideano hacia tres importantes instituciones museísticas como lo son el Museo del Cabildo, el Museo del Carnaval y el Museo de Historia del Arte. El objetivo del trabajo es estimar la demanda y obtener un indicador de la propensión a pagar por el consumo de dichos museos. El segundo trabajo, titulado “Disposición a pagar por la restauración de la Puerta de la Ciudadela”, fue realizado por las Contadoras Beatriz Torres, María Elena Olarán y María Carolina Duarte, y tutorado en forma conjunta por el Phd. Juan José Goyeneche y quien les escribe. En este trabajo se realiza una valoración contingente para medir la disposición a pagar por la restauración de la “Puerta de la Ciudadela”, un monumento fundamental de identidad montevideana. El capítulo de Patrimonio finaliza con un trabajo realizado por las Economistas Malena Rodríguez y María de la Paz Besada y tutorado por el Ec. Luis Stolovich. El mismo se denomina “El arte uruguayo: un estudio sobre el mercado y la pintura como alternativa de inversión” y explora el mercado de arte uruguayo, analizando la rentabilidad de la inversión en pintura uruguaya. Tratan la rentabilidad de la inversión para tres casos específicos: las obras vendidas por el Banco Comercial en su proceso de recuperación de activos, un portafolio de obras de Pedro Figari y otro de Joaquín Torres García. En cuanto al segundo capítulo, Artes Escénicas, comienza con un trabajo realizado para la obtención del título de Contador Público realizado por Pamela Cambeiro, Martín Cami e Ignacio Mouradián. Se denomina “La gestión de teatros. Caso de estudio: Aplicación del Cuadro de Mando Integral al Teatro Solís” y trata sobre la identificación de indicadores que faciliten las tareas de gestión para la dirección del Teatro. Luego se presenta un trabajo realizado por las Economistas Tania Cruz y Natalia Nollenberger titulado “Análisis económico del teatro independiente en Montevideo: una aproximación al problema de la fatalidad de los costos”. Este trabajo, también tutorado por el Ec. Luis Stolovich, muestra un exhaustivo análisis del teatro independiente montevideano identificando los problemas económicos que afectan al sector. El capítulo de Industria Cultural incluye tres trabajos. El primero, fue realizado por el Economista Diego Traverso y tutorado por el Dr. Gustavo Buquet, y su título es “Análisis de competitividad del sector exportador de Productoras Audiovisuales Publicitarias en Uruguay”. El sector audiovisual publicitario es un sector dinámico que se ha internacionalizado tempranamente y que generó divisas para el país del orden de los US$ 24 millones durante el año 2005 por concepto de exportaciones. En este trabajo se caracteriza al sector audiovisual publicitario en Uruguay y se analiza las ventajas competitivas que posee frente a sus principales competidores extranjeros. El segundo trabajo fue realizado por las Contadoras Natalia Rivera, Antonella Triay y María Eugenia Triay y se denomina “Gestión aplicada a las empresas radiales”. En este se identifican el sector radial, su proceso productivo y la complejidad al definir al “cliente”. Se proponen una serie de indicadores con el doble objetivo de medir el desempeño de la empresa y proveer incentivos a su organización. Finalmente, el último trabajo monográfico, fue una investigación interdisciplinaria, que sirvió simultáneamente para obtener el título de Licenciado en Economía a Ernesto Pienika y el de Licenciado en Administración a Nicolás Cohnheim y a Damián Geinsinger. Este trabajo, tutorado por el Dr. Gustavo Buquet y el Cr. Cecilio García de título “Impactos de las nuevas tecnologías en la .industria musical”, muestra cuáles son los principales impactos en esa industria que las nuevas tecnologías han provocado y cuáles son las posibles estrategias para adaptarse a estos cambios, así como los nuevos modelos de negocio. Espero que este libro sea el primero de una larga lista. Las áreas de Economía de la Cultura y Gestión de Organizaciones Culturales son disciplinas jóvenes que necesitan seguir creciendo. La investigación realizada por trabajos monográficos de fin de carrera en estas áreas, será siempre bienvenida. (shrink)

En este trabajo discutimos la extensión de la influencia que el pensamiento de Richard Owen tuvo sobre el de Charles Darwin. Además, se intentará mostrar lo heterogéneo de tal influencia, que va desde teorías específicas a giros retóricos. Esta influencia es en muchos casos subestimada, dando la sensación de que la novedad darwiniana consistió únicamente en mirar con ojos desprejuiciados lo que los otros no habían visto. Esta visión resulta injusta con Owen, y también con el esfuerzo conceptual llevado adelante (...) por Darwin con las piezas brindadas por sus precursores. Finalmente, este es un caso interesante para entender el tipo de novedad aportada por las revoluciones científicas y el modo sofisticado en que tal novedad se sustenta sobre el trabajo de los enfoques previos. The aim of this study was to explore the existence of moral distress among nurses in Lilongwe District of Malawi. Qualitative research was conducted in selected health institutions of Lilongwe District in Malawi to assess knowledge and causes of moral distress among nurses and coping mechanisms and sources of support that are used by morally distressed nurses. Data were collected from a purposive sample of 20 nurses through in-depth interviews using a semi-structured interview guide. Thematic analysis of qualitative data was (...) used. The results show that nurses, irrespective of age, work experience and tribe, experienced moral distress related to patient/nursing care. The major distressing factors were inadequate resources and lack of respect from patients, guardians, peers and bosses. Nurses desire teamwork and ethics committees in their health institutions as a means of controlling and preventing moral distress. There is a need for creation of awareness for nurses to recognize and manage moral distress, thus optimizing their ability to provide quality and uncompromised nursing care. (shrink)

Dialogamos con Cintia Rodríguez Garat, quien obtuvo el Primer Premio Bioética 2023 de la Fundación Jaime Roca por su trabajo “Resiliencia y salud pública de las mujeres mapuce ante el cambio climático. Un análisis desde una perspectiva intercultural, participativa y de derechos humanos”.

El objetivo de este artículo es realizar una historización del sistema sanitario de Neuquén, concretamente atendiendo a los programas de salud aplicados en esta provincia desde su surgimiento hasta el año 2020. En este marco, en primer lugar, me enfocaré en los lineamientos políticos que definieron las bases ideológicas de las políticas públicas llevadas a cabo en la atención sanitaria neuquina, y, en segundo lugar, examinaré las variables estadísticas publicadas por el sistema de salud provincial referidas a las condiciones materiales (...) de atención médica de la población en general, y de las mujeres indígenas mapuce en particular. Bertrand Russell argued that any attempt to get rid of universals in favor of resemblances fails. He argued that no resemblance theory could avoid postulating a universal of resemblance without falling prey to a vicious infinite regress. He added that admitting such a universal of resemblance made it pointless to avoid other universals. In this paper I defend resemblance nominalism from both of Russell's points by arguing that (a) resemblance nominalism can avoid the postulation of a universal of resemblance without (...) falling into a vicious infinite regress, and (b) even if resemblance nominalism had to admit a universal of resemblance, this would not make it pointless to avoid postulating other universals. Police officers are vital to maintaining security and the continuity of national functions. Thus, Police officers are more exposed to different kinds of psychological concerns. However, a female in this kind of profession, based on various studies, experienced higher levels of stress because of other factors. Further, the primary goal of this study is to investigate the psychological well-being, lived experiences, challenges, and coping mechanisms of female police officers. Employing the Interpretative Phenomenological Analysis, the findings of this study were: (1) (...) Female police officers had conceptualized themselves as brave, flexible, and adaptive. And they cope with stress with positive thinking that results in healthy psychological well-being. (2) Female police officers showed dedication and engagement to serve the people. They even used their resources for the public and sacrificed most of their time in the office. (3) Female police officers' primary motivation to continue their careers is their families, and serving the public brings joy to them. (4) However, female police officers experience disrespect while working in the field, and they always have fear in their life as police officers. Moreover, they need more time to spend with their families. Furthermore, it is highly suggested to provide opportunities for enhancing quality time with their family, specifically with their children. (shrink)

Resemblance Nominalism is the view that denies universals and tropes and claims that what makes F-things F is their resemblances. A famous argument against Resemblance Nominalism is Russell's regress of resemblances, according to which the resemblance nominalist falls into a vicious infinite regress. Aristocratic Resemblance Nominalism, as opposed to Egalitarian Resemblance Nominalism, is the version of Resemblance Nominalism that claims that what makes F-things F is that they resemble the F-paradigms. In this paper I present what I call the 'Metaphysical Problem of Truth', which consists in explaining in virtue of what all true sentences are true, and argue that a version of the Correspondence Theory of Truth is the most plausible solution to this problem.

1. The Bundle Theory I shall discuss is a theory about the nature of substances or concrete particulars, like apples, chairs, atoms, stars and people. The point of the Bundle Theory is to avoid undesirable entities like substrata that allegedly constitute particulars. The version of the Bundle Theory I shall discuss takes particulars to be entirely constituted by the universals they instantiate.' Thus particulars are said to be just bundles of universals. Together with the claim that it is necessary that (...) particulars have constituents, the fundamental claim of the Bundle Theory is: (BT) Necessarily, for every particular x and every entity y, y constitutes x if and only ify is a universal and x instantiates y. 2 The standard and supposedly devastating objection to the Bundle Theory is that it entails or is committed to a false version of the Principle of Identity of Indiscernibles (Armstrong 1978: 91, Loux 1998: 107), namely: (Pll) Necessarily, for all particulars x and y and every universal z, if z is instantiated by x if and only if z is instantiated byy, then x is numerically identical with y. The most famous counterexample to the Identity of Indiscernibles is that put forward by Max Black, consisting of a world where there are only two iron spheres two miles apart from each other, having the same diameter, temperature, colour, shape, size, etc (Black 1952: 156). Let us from now on think of the properties of the spheres in this world as universals. The possibility of this world, which I shall hereafter refer to as 'Black's world', makes (Pll) false.' Objetivando compreender em que medida essas classificações poderiam ser consideradas métodos construídos pelos filósofos gregos para o estudo dos seres vivos, conforme lhes denomina historicamente a literatura biológica, foram consultadas as obras platônicas, Timeu e O Político, e as aristotélicas, Partes dos Animais e História dos Animais. Buscou-se demarcar nestas obras como e para que empregaram a classificação no que diz respeito aos (...) seres vivos. Ao final, trazemos argumentos para explicar porque as classificações gregas não devem ser consideradas métodos na Biologia. (shrink)

In 2016, Béziau introduces a restricted notion of paraconsistency, the so-called genuine paraconsistency. A logic is genuine paraconsistent if it rejects the laws $\varphi,\neg \varphi \vdash \psi$ and $\vdash \neg (\varphi \wedge \neg \varphi)$. In that paper, the author analyzes, among the three-valued logics, which of them satisfy this property. If we consider multiple-conclusion consequence relations, the dual properties of those above-mentioned are $\vdash \varphi, \neg \varphi$ and $\neg (\varphi \vee \neg \varphi) \vdash$. We call genuine paracomplete logics those rejecting (...) the mentioned properties. We present here an analysis of the three-valued genuine paracomplete logics. A very natural twist structures semantics for these logics is also found in a systematic way. This semantics produces automatically a simple and elegant Hilbert-style characterization for all these logics. Finally, we introduce the logic LGP which is genuine paracomplete is not genuine paraconsistent, not even paraconsistent and cannot be characterized by a single finite logical matrix. (shrink)

Nuestro objetivo consiste en caracterizar la ontología corporal de las mujeres indígenas mapuce desde el esquema epistemológico sujeto-sujeto, propio de las teorías decoloniales. En este aspecto, nos interesa desnaturalizar ciertos mecanismos de subalternización, en tanto huellas de la colonialidad, que siguen operando no solo en la construcción de sentidos, sino también como reproductores de la opresión interseccional que experimentan estas mujeres. Preliminarmente, para este planteo, nos enfocaremos en la delimitación del concepto de interseccionalidad. Luego, intentaremos articular, desde un planteo feminista (...) decolonial, diversas narrativas de estas mujeres mapuce, vinculadas a la precarización de sus vidas y su salud, como parte de las violencias instituidas por la cultura hegemónica. Finalmente, nos resulta fundamental poner de relieve la resiliencia de las culturas subalternizadas, como forma horizontalizada de narrativizar un sentir decolonial desde la memoria performativa del cuerpo, contra ciertos dispositivos de subalternización, a partir de la clara referencia a las luchas y re-existencias de las mujeres indígenas mapuce, en el marco de una perspectiva situada en la decolonización, la emancipación y la liberación de los pueblos oprimidos. The aim of this study is to describe organizational commitment between type A personality’s and type B is personality’s workers on three companies. Organizational commitment is define as the degree of psychological identification with or attachment to the organization for which we work. Participant of this study was 108 workers from three different companies. Data was obtained by questionnaire and processed with SPSS for Windows ver. 12. Using Mann-Whitney independent t-test for non parametric, the result of organizational commitment U = (...) 1183, p > 0.05, showed that there is no difference of organizational commitment between type A personality and type B personality on company X, Y, and Z. Since 1968, the irreversible loss of functioning of the whole brain, called brain death, is assimilated to individual’s death. The almost universal acceptance of this neurological criterion of death had decisive consequences for the contemporary medicine, such as the withdrawal of mechanical ventilation in these patients and organ retrieval for transplantation. The new criterion was successfully accepted in part because the assimilation of brain death state to death was presented by medicine --and acritically assumed by most of societies-- as a (...) scientific and objective fact. Nevertheless, many people do not think that the patients suffering brain death are actually dead. We show here that those people are not necessarily wrong. It can be argued that, in fact, the justification of the neurological criterion is not scientific but moral. We outline the thesis that the problem surrounding the vital status of brain dead patients is due to a confusion between factual and normative questions. Furthermore, we claim that the donation of organs and the withdrawal of life-support could be ethically acceptable even if the patients suffering brain death are considered as alive. As an alternative to the dead donor rule, we propose a justification for organ donation of brain-dead patients based on the (moral) concepts of harm and consent : what truly justifies the procurement of organs on those patients is not that they are dead, but that they wish to donate their organs and that, since they have irreversibly lost their brain, they cannot be harmed. At a crucial juncture in Plato’s Sophist, when the interlocutors have reached their deepest confusion about being and not-being, the Eleatic Visitor proclaims that there is yet hope. Insofar as they clarify one, he maintains, they will equally clarify the other. But what justifies the Visitor’s seemingly oracular prediction? A new interpretation explains how the Visitor’s hope is in fact warranted by the peculiar aporia they find themselves in. The intuitive distinction between natural and unnatural properties (e.g., green vs. grue) informs our theorizing not only in fundamental physics, but also in non-fundamental domains. This paper develops a reductive account of this broad notion of naturalness that covers non-fundamental properties: for a property to be natural, I propose, is for it to figure in a law of nature. After motivating the account, I defend it from a potential circularity charge. I argue that a suitably broad notion of lawhood can (...) be defined independently of naturalness, if we help ourselves to the notion of a fundamental physical property. I end by showing how the notions of naturalness and lawhood that my account delivers help illuminate a number of other important philosophical notions, like causation, reference/meaning, and rational induction. Aristotle recognizes a series of difficulties when it comes to understanding the starting points of a scientific or philosophical system, and contemporary scholars have encountered their own difficulties in understanding his response. I will argue that Aristotle was aware of a Platonic solution that can help us uncover his own attitude toward the problem.Aristotle's central problem with first principles arises from the (...) fact that they cannot be demonstrated in the same way as other propositions. Resumen: La capacidad unificadora de una teoría científica es un rasgo usualmente contemplado a la hora de evaluar su adecuación. Kitcher ha elucidado satisfactoriamente tal noción mediante su enfoque de los patrones explicativos. Sin embargo, su perspectiva adolece de ciertas carencias. Concretamente, sostendremos que el requisito de rigurosidad de los patrones para evaluar la capacidad unificadora debe ser repensado, pues atenta contra la heterogeneidad característica de las diferentes aplicaciones de teorías unificadoras. A su vez, mostraremos cómo estas dificultades bien pueden (...) ser subsanadas desde el marco del estructuralismo metateórico sin por ello resignar ninguna de las acertadas intuiciones de Kitcher. -/- Palabras clave: Explicación, Kitcher, estructuralismo metateórico, unificación, unificación espuria. -/- Abstract: Kitcher has satisfactorily explicated unification using his particular approach to scientific explanation. However, we believe that his perspective has certain problems, which have been inherited by more recent approaches to the topic. Specifically, the requirement of stringency of patterns that Kitcher proposes to determine the unifying power of an explanatory pattern undermines the typical and peculiar heterogeneity we can find in different applications of unifying theories. Background Consent policies for post-mortem organ procurement (OP) vary throughout Europe, and yet no studies have empirically evaluated the ethical implications of contrasting consent models. To fill this gap, we introduce a novel indicator of governance quality based on the ideal of informed support, and examine national differences on this measure through a quantitative survey of OP policy informedness and preferences in seven European countries. -/- Methods Between 2017–2019, we conducted a convenience sample survey of students (n = 2006) in (...) Austria (AT), Belgium (BE), Denmark (DK), Germany (DE), Greece (GR), Slovenia (SI) and Spain (ES), asking participants about their donation preferences, as well as their beliefs and views about the policy in place. From these measures, we computed indices of informedness, policy support, and fulfilment of unexpressed preferences, which we compared across countries and consent systems. -/- Results Our study introduces a tool for analyzing policy governance in the context of OP. Wide variation in policy awareness was observed: Most respondents in DK, DE, AT and BE correctly identified the policy in place, while those in SI, GR and ES did not. Respondents in opt-out countries (AT, BE, ES and GR) tended to support the policy in place (with one exception, i.e., SI), whereas those in opt-in countries (DE and DK) overwhelmingly opposed it. These results reveal stark differences in governance quality across countries and consent policies: We found a preponderance of informed opposition in opt-in countries and a general tendency towards support–either informed or uninformed–in opt-out countries. We also found informed divergence in opt-in countries and a tendency for convergence–either informed or uninformed–among opt-out countries. -/- Conclusion Our study offers a novel tool for analyzing governance quality and illustrates, in the context of OP, how the strengths and weaknesses of different policy implementations can be estimated and compared using quantitative survey data. Sacrificial dilemmas such as the trolley problem play an important role in experimental philosophy (x-phi). But it is increasingly argued that, since we are not likely to encounter runaway trolleys in our daily life, the usefulness of such thought experiments for understanding moral judgments in more ecologically valid contexts may be limited. However, similar sacrificial dilemmas are experienced in real life by animal research decision makers. As part of their job, they must make decisions about the suffering, and often the (...) death, of many non-human animals. For this reason, a context-specific investigation of so-called “3R dilemmas” (i.e., dilemmas where there is a conflict between the principles of replacement, reduction, and refinement of the use of animals in research) is essential to improve the situation of both non-human animals and human stakeholders. An approach well suited for such investigation is experimental philosophical bioethics (“bioxphi”), which draws on methods similar to x-phi to probe more realistic, practical scenarios with an eye to informing normative debates and ethical policy. In this article, we argue for a need to investigate 3R dilemmas among professional decision-makers using the tools of bioxphi. In a first step, we define 3R dilemmas and discuss previous investigations of professionals’ attitudes in such cases. In a second step, we show how bioxphi is a promising method to investigate the whys and hows of professional decision-making in 3R dilemmas. In a last step, we provide a bioxphi template for 3R dilemmas, give recommendations on its use, explore the normative relevance of data collected by such means, and discuss important limitations. En su artículo clásico, Gould y Lewontin (1979) han esgrimido críticas no siempre claras - contra el así llamado "programa adaptacionista". Puesto que una "adaptación" en uno de los sentidos más utilizados del vocablo - refiere a un rasgo cuya fijación en una población se explica por selección natural, el encuentro de adaptaciones ha sido considerado una heurística que guía a los biólogos en la aplicación de la teoría de la evolución por selección natural, procurando extender el campo de aplicación (...) de la teoría a priori, y sin restricción alguna, al mejor estilo kuhneano. Este trabajo procura elucidar, breve, pero integralmente, las críticas contenidas en el artículo aludido, donde se reconocen objeciones de diversa índole, a saber: empíricas, metodológicas, conceptuales, y pragmáticas, aunque con solapamientos. Se evalúa el filo de algunas de ellas, y se estipula la utilidad potencial que elucidaciones conceptuales como las que se ofrecen aquí pueden tener para con la filosofía de la biología. (shrink)

I offer a close reading of the first part of Sartre's The Transcendence of the Ego, arguing that contrary to widely held interpretation, one of Sartre's main goals in that text is to defend the view that consciousness does not necessitate self-awareness, that not all conscious states need be, ipso facto, states of self-awareness. In addition, I explain that this view about the conceptual relationship between consciousness and self-awareness has important methodological implications. One of the standard strategies for accounting for (...) the possibility of the type of capacity to have I* thoughts and attitudes is based on the assumption that being conscious necessarily entails being self-aware in at least a minimal sense, and then proceeds to explain how it I*-thoughts and attitudes are possible on the basis of those minimal states of self-awareness. Yet if Sartre's account of self-awareness is so much as plausible, this kind of strategy is bound to be incomplete. By helping itself to a notion of minimal self-awareness that is purportedly constitutive of consciousness, it fails to account for what is, by its own lights, the most fundamental form of self-awareness. The paper argues that grounding is neither irreflexive, nor asymmetric, nor transitive. In arguing for that conclusion the paper also arguesthat truthmaking is neither irreflexive, nor asymmetric, nor transitive.

According to one of Leibniz's theories of contingency a proposition is contingent if and only if it cannot be proved in a finite number of steps. It has been argued that this faces the Problem of Lucky Proof , namely that we could begin by analysing the concept ‘Peter’ by saying that ‘Peter is a denier of Christ and …’, thereby having proved the proposition ‘Peter denies Christ’ in a finite number of steps. It also faces a more general but (...) related problem that we dub the Problem of Guaranteed Proof . We argue that Leibniz has an answer to these problems since for him one has not proved that ‘Peter denies Christ’ unless one has also proved that ‘Peter’ is a consistent concept, an impossible task since it requires the full decomposition of the infinite concept ‘Peter’. We defend this view from objections found in the literature and maintain that for Leibniz all truths about created individual beings are contingent. (shrink)

Con el objetivo de reflexionar sobre la potencialidad filosófica y política que tienen los afectos “negativos”, me interesa repensar el rol social de estos afectos a partir de abordar los efectos, en términos de agencialidad, que pueden propiciar en el ámbito político. Para ello, comenzaré con una breve caracterización sobre las implicancias del concepto de “olas” del feminismo, para entender a grandes rasgos los cambios históricos conquistados por las luchas feministas y los activismos. En este sentido, me situaré en la (...) “cuarta ola” del feminismo para abordar las nociones vinculadas al giro afectivo, a partir del fuerte cuestionamiento que esta matriz teórica le realiza a la noción de temporalidad lineal. Finalmente, analizaré la potencialidad que portan los afectos “negativos” en la escena política, a partir de resaltar el fuerte tono revolucionario que estas emociones, en tanto expresiones de la visceralidad, pueden tener en la transformación de la sociedad cuando irrumpen en el orden público. Trías recoge esta determinación en un concepto clave de su filosofía al denominarnos “ser del límite”. En ambos filósofos somos radicalmente pasión creadora; somos un animal límite y caótico, sufriente por queriente, y potencialmente feliz por el mismo motivo. This essay proposes a reductive account of robust macro-regularities. On the view proposed, regularities can earn their elite scientific status by featuring in good summaries of restricted regions in the space of physical possibilities: our “modal neighborhoods.” I argue that this view vindicates “nomic foundationalism”, while doing justice to the practice of invoking physically contingent generalizations in higher-level explanations. Moreover, the view suggests an explanation for the particular significance of robust macro-regularities: we rely on summaries of our modal neighborhoods when (...) reasoning hypothetically about “agentially accessible” possibilities. Este trabajo se propone documentar y reflexionar sobre la utilización de herramientas pedagógico-didácticas en tiempos de SAR-COV-2 desde el espacio de la Práctica Docente de los Institutos de Formación Docente del Distrito 040-General Madariaga, provincia de Buenos Aires (ISFD N°169; ISFDyT N°59). Motiva la investigación que existen pocos trabajos empíricos que documenten las experiencias de la práctica docente en esta zona y en este contexto sanitario. Desde una perspectiva crítica se dará cuenta de las concepciones, utilización de herramientas y estrategias (...) que se ponen en juego desde las prácticas y residencia de los Profesorados de Inicial y Primaria, durante la pandemia mencionada. Se trata de una investigación cualitativa, exploratoria. Como resultados principales se abordarán la resignificación de distintas herramientas pedagógico-didácticas, como las videollamadas; la organización de contenidos mediante Classroom, Plataformas digitales y el dictado de clases por canales de YouTube. La finalidad es subrayar como común denominador la búsqueda de alternativas de interacción gratuitas, por parte de las docentes que, en casi la totalidad de los casos, tuvieron que garantizar la continuidad pedagógica mediante la propia construcción de dichos canales de comunicación. Preface to the Thematic Volume: Models and Theories in Biology.

The Protein Ontology provides terms for and supports annotation of species-specific protein complexes in an ontology framework that relates them both to their components and to species-independent families of complexes. Comprehensive curation of experimentally known forms and annotations thereof is expected to expose discrepancies, differences, and gaps in our knowledge. We have annotated the early events of innate immune signaling mediated by Toll-Like Receptor 3 and 4 complexes in human, mouse, and chicken. The resulting ontology and annotation data set has (...) allowed us to identify species-specific gaps in experimental data and possible functional differences between species, and to employ inferred structural and functional relationships to suggest plausible resolutions of these discrepancies and gaps. Gorgias’ On Not-Being survives only in two divergent summaries. Diels–Kranz's classic edition prints the better-preserved version that appears in Sextus’ Aduersus Mathematicos. Yet, in recent years there has been rising interest in a second summary that survives as part of the anonymous De Melisso, Xenophane, Gorgia. The text of MXG is more difficult; it contains substantial lacunae that often make it much harder to make grammatical let alone philosophical sense of. As Alexander Mourelatos reports, one manuscript has a scribal note (...) that reads: "The original contains many errors; no one should blame me; I just copy what I see.". The treatise's state of preservation has aptly prompted Michael Gagarin to liken it to a black hole: "something we cannot see directly but know must exist because of certain effects it has on other objects.". ¿Cómo es posible encontrar una constante en una obra que tiene en la ruptura su principal argumento? Una primera línea se puede percibir en el trabajo de Žižek sobre una política del goce cuya trayectoria circula desde el deseo a la pulsión. Desde una investigación muy orientada en el problema del sujeto, en el carácter sintomático del mismo, Žižek se ha desplazado hacia un análisis de la relación entre el objeto a y la pulsión en el marco del capitalismo actual. En conexión con esta problemática se encuentra una segunda línea que tiene como punto central el trabajo crítico sobre las relaciones entre economía y política; frente al desafío que supone hoy en día la circulación espontánea del capital y el abandono del ámbito económico por parte de la teoría política. Por un lado nos encontramos con los dos sentidos del término escatología, el económico y el teológico-político, que convergen en la noción de exceso, sea de la pulsión o sea del objeto a. Al mismo tiempo, Žižek considera que no es posible traducir la atención sobre el exceso capitalista y su propia revolución inmanente en términos de dominación política.Ambas secuencias se encuentran, en definitiva, íntimamente vinculadas en la crítica de la economía política del discurso que Žižek lleva a cabo. La introducción del término paralaje puede servir como alternativa para entender la oscilación permanente que se produce en su obra entre síntoma y escatología. Una opción para leer a Žižek en función de sus incesantes desplazamientos, comenzando por el más fundamental: la paralaje entre lectura y escritura. (shrink)

El artículo analiza el papel del resentimiento en la Teoría de los sentimientos morales de Adam Smith y su conexión con el proceso de la simpatía mutua por medio del cual el “espectador imparcial” asume plenamente el resentimiento de la víctima, al considerar que su pasión se rige por los principios de la propiedad y la justicia. Se sostiene que el resentimiento no solo cumple un rol central en la teoría del castigo de Adam Smith, en la medida en que (...) permite retribuir, disuadir y rehabilitar al victimario sino que, además, aporta a la discusión contemporánea sobre el perdón y la reconciliación, pues convoca la posibilidad de superar el resentimiento y restablecer las relaciones sociales entre el agresor y la víctima. In this paper we present a new framework of idealization in biology. We characterize idealizations as a network of counterfactual and hypothetical conditionals that can exhibit different “degrees of contingency”. We use this idea to say that, in departing more or less from the actual world, idealizations can serve numerous epistemic, methodological or heuristic purposes within scientific research. We defend that, in part, this structure explains why idealizations, despite being deformations of reality, are so successful in scientific practice. Plato’s Parmenides and Lysis have a surprising amount in common from a methodological standpoint. Both systematically employ a method that I call ‘exploring both sides’, a philosophical method for encouraging further inquiry and comprehensively understanding the truth. Both have also been held in suspicion by interpreters for containing what looks uncomfortably similar to sophistic methodology. I argue that the methodological connections across these and other dialogues relieve those suspicions and push back against a standard developmentalist story about Plato’s method. This (...) allows for a better understanding of why exploring both sides is explicitly recommended in the Parmenides and its role within Plato’s broader methodological repertoire. (shrink)

Lo anterior, a partir de dos elementos claves para entender el papel de los mecanismos jurídicos en la defensa de la naturaleza y el ambiente: la participación ambiental y el acceso a la justicia ambiental, ello, con el fin de conocer los instrumentos que reconfiguran el Estado para (...) que la ciudadanía y las organizaciones sociales puedan ejercer una defensa jurídica del medio ambiente, que aporte a la construcción de la justicia ambiental. Consider a certain red rose. The proposition that the rose is red is true because the rose is red. One might say as well that the proposition that the rose is red is made true by the rose’s being red. This, it has been thought, does not commit one to a truthmaker of the proposition that the rose is red. For there is no entity that makes the proposition true. What makes it true is how the rose is, and how (...) the rose is is not an entity over and above the rose. It is against this view that I shall argue in this paper. I shall argue that a significant class of true propositions, including inessential predications like the proposition that the rose is red, are made true by entities. "No truthmaking without truthmakers" is my slogan. Although I have my view about what kinds of entities are truthmakers, I shall not argue for or presuppose that view here. All I shall argue for here is that if a proposition is made true by something, it is made true by some thing, but my argument will leave it open what kind of thing that thing is: it could be a fact or state of affairs, a trope, or any other sort of entity. En este ensayo nos proponemos realizar algunas consideraciones argumentativas breves sobre la ética en investigaciones con seres humanos vulnerables. Para ello, examinaremos el conocido caso de Tuskegee (Alabama), ocurrido entre los años 1932-1972, en el que 600 personas afroamericanas fueron inoculadas con sífilis sin su consentimiento. Luego, desde una postura crítica, abordaremos el caso desde tres perspectivas bioéticas. En primer lugar, lo analizaremos desde el plano jurídico-normativo, luego desde el principialismo formulado por Tom Beauchamp y James Childress, y finalmente, desde (...) el enfoque conceptual de la “vulnerabilidad”, referido a las poblaciones participantes en las investigaciones bioéticas. En efecto, nos centraremos en los miramientos que estos enfoques plantean de forma expresa, para realizar un análisis reflexivo sobre el necesario aspecto ético, requerido en el seno de toda investigación bioética con personas vulnerables. En el presente artículo se presenta el panorama y algunos de los más importantes avances que en Colombia se han dado en materia ambiental desde la Constitución Política de 1991. La metodología llevada a cabo es descriptiva y analítica, en tanto se estudian no sólo las normas sino las sentencias más relevantes que se han constituido en un hito en la protección de los derechos ambientales. En tal sentido, lo que se pretende evidenciar es la existencia de un panorama de (...) constitucionalización de los derechos ambientales con signicativos avances tales como el rol preponderante que ha adquirido el principio de precaución o el reconocimiento de la función ecológica de la propiedad. En el presente trabajo reflexionamos en torno a una serie de textos en los que Michel Foucault se pregunta por estatuto de la crítica. La cuestión nos parece volverse reflexivamente sobre el propio Foucualt y por ello intentaremos evaluar de qué manera, con sus propios recursos conceptuales, se puede determinar el estatuto de su propio discurso. Para ello recorreremos dos caminos: (i) su rechazo de la noción de ideología que lo pone en tensión con algunas de las tradiciones mayores del (...) pensamiento crítico. La cuestión es aquí: ¿cómo es posible la crítica sin la ideología y sin la verdad?; (ii) la recuperación foucaultiana de la actitud crítica (en los textos sobre Kant y la pregunta Was ist Aufklärung?). A partir de allí Foucault recupera la problemática de la modernidad en términos de una “ontología histórica del presente”. Ambos caminos se cruzan, ya que las observaciones sobre una “política de la verdad” (lo otro de la crítica de la ideología comprometida con una verdad aséptica) se refuerzan con las de la cuestión del gobierno en términos de una “inservidumbre voluntaria”. En ambos casos, la práctica de la crítica, que subjetiviza desujetando, plantea la cuestión de la libertad. -/- We analyze Michel Foucault’s question for the status of critique and its reflexive return over Foucault himself: How Foucault’s discourse, qua critique, should be understood? We will drive two paths: (i) the refusal of the notion of ideology, where the question is: How to think of critique without ideology and truth?; (ii) the Foucauldian recovery of the “critical attitude” (in the texts on Kant’s answer to the question Was ist Aufklärung?) and of the problem of modernity, along the lines of a “historical ontology of the present”. There is a crossroad of (i) and (ii), since the remarks on a “politics of truth” (as opposite to an “ideology critique” committed with an aseptic truth) reinforces mutually with the problem of the government, faced along the lines of an art of the “voluntary inservitude”. In both cases, practice of criticism that subjectifies desubjugating, poses the question of liberty. (shrink)
